vic state govtThe Andrews Labor Government is warning employers not to become complacent about the dangers of working from heights, warning they will be held accountable for putting workers lives at risk.

WorkSafe Victoria inspectors have been targeting work sites since November, with a focus on fall prevention, scaffolding safety and ladder use in the construction industry, after two fall-related fatalities and a number of serious incidents last year.

Since November, WorkSafe inspectors have completed more than 220 checklists in visits to domestic and commercial construction sites, with falls from height compliance issues identified in almost every list.

worksafe current survey 1The Victorian government has recently introduced legislation to increase the maximum penalty for manslaughter and similar offences. This includes the not yet commenced workplace manslaughter offence, which is proposed to now have a maximum penalty of 25 years imprisonment.

The Victorian government has also launched a media campaign to publicise the new workplace manslaughter laws starting on 1 July 2020.  The construction industry is one of three industries that will be the focus of this campaign, along with agriculture and manufacturing.

The message from the government is that if you don’t take care of your employees at work and ensure they return home safe, the government will make sure that you are responsible for the consequences. The campaign also states that workplace manslaughter will be a jailable offence.

However not every workplace death will result in an employer going to jail for workplace manslaughter.  The prosecution will have to prove that the employer failed to comply with their OH&S duties, caused the death of the employee and was criminally negligent.  Employees killed by the criminal negligence of other employees without employer culpability will also not result in prosecutions.  It is expected that only cases of gross negligence by employers will result in charges and possible jail terms.

This government campaign is a reminder of the importance of ensuring that you have suitable OH&S systems and procedures in place, and that you also use them, regularly review them, and follow up any safety issues if they arise.

Outdoor Society Logo Thumbnail 01The Outdoor Society was started by Adam Marsal and been in operation since 2012. Our vision is to create absolutely amazing spaces!

Our primary focus is landscape and pool construction. We love to create our own designs with our clients, and also work with pool builders, designers and architects.

We love building spaces that people can enjoy.  We are fortunate to be part of a well-established industry, to share and draw from the talent and experience of members of our community, and also - importantly - to give back to that community.

We work directly alongside pool builders, as we are able to complete the components that fall outside the scope of the immediate pool sphere. We enable pool builders to successfully complete an overall project and deliver to their clients. Being exceptionally passionate about our profession, there are a great many values that we hold dear in completing projects. We love to overcome challenges and we believe our success at this sets us apart from our competitors.

Our aim is for our clients to be educated about the process involved in achieving their project from start to finish. We always strive to be attentive to our clients' needs, to be clear in our communications throughout the project and ensure good documentation processes.

We look forward to being a part of the SPASAVIC community by attending industry events and meeting other members in the indutsry.
